FIRST.- BASES OF THE PROMOTION

I.Personal and territorial scope:

All Internet users over 18 years of age and residents throughout Spanish territory may participate in the promotion organized by BARBELL STUDIO, SL with NIF B40656845 (hereinafter POWERBARBELL).

Minors, POWERBARBELL employees, as well as employees of collaborating companies participating in this promotion are excluded from participating in this promotion. Likewise, family members (third degree or lower due to consanguinity or affinity) will not be able to participate. of these, nor in general legal persons.

II.- Temporal scope:

The promotion will run from February 22 to 25, 2024.

III.- Access to promotion and participation:

To participate in the promotion that will be carried out under the conditions established in these rules. In this promotion, prizes will be drawn consisting of 1,288 50% discount codes, 150 brand products, an iPhone 15 and a PlayStation 5 (hereinafter, the “Prize”).

SECOND.- OBJECT

THIRD.- PRIZE

The marketing and/or sale of the prize is prohibited.

FOURTH.- PARTICIPATION MECHANICS

Users can enter multiple times as long as they meet the sweepstakes requirements.

FIFTH.- DRAWING MECHANICS

Once this promotion has ended, POWERBARBELL, with all the Internet users who have participated, following the terms established in these rules, will prepare a numbered file calling it a list of participants. The day after the promotion ends, POWERBARBELL will randomly select the winners through the Easypromos program.

SIXTH.- COMMUNICATION OF WINNERS AND DELIVERY OF PRIZES

The name of the winner of the products will be published in the following days of their choice at: https://www.instagram.com/pbsapparel_

Within a period of two days, POWERBARBELL will contact the winner, via private message and mentioning them in a comment in the same raffle post, providing them with the instructions to follow to obtain the prize and request its acceptance. POWERBARBELL reserves the right to request the sending of a copy of your ID, as proof of your address and age, for the purposes of sending you the prize obtained. If within a maximum period of 5 days, from the date of publication of the comment in the post, the winner does not confirm or accept the prize, it will be understood as non-acceptance of the prize, giving way to reservations. POWERBARBELL will send the prize obtained to the email address provided by the winning participants at no cost to them within a period of one week from its confirmation and/or acceptance. The prize awarded is non-transferable, that is, in the event that for any circumstance the winners or the selected reserves could not or did not want to accept the prize or renounce it, the address provided could not be contacted, or they did not comply with the requirements established in these Rules, and even if there were no participants, the prize will be declared void.

SEVENTH.- CLAIM

The claim period for any problem or eventuality related to this promotion will end three months after the end of the promotional period.

EIGHTH.- ACCEPTANCE OF BASES

 Participants, by the mere fact of participating in this promotion, accept its rules and POWERBARBELL's criteria regarding the resolution of any issue arising from its development.

POWERBARBELL may, in the event of detecting fraudulent use of the promotion, modify these bases in those provisions that are pertinent to achieve its correct functioning.

NINTH.- EXEMPTION OF LIABILITY

POWERBARBELL is exonerated from all responsibility in the event of possible losses, deterioration, theft, delay, malfunction of the Internet network, any other circumstance and incorrect transmission of content, which prevents the normal development of the promotion for reasons beyond the control of the company and especially for external acts of bad faith, as well as any type of claim for authorship without consent on the part of its owner regarding the material presented by the participants in this promotion.

Within three months from the end of the promotional action, the data of participants who have not won will be automatically destroyed.

The legal basis for the processing of your personal data is the consent given to participate in the draw.

Your personal data will not be transferred to any third party, except in those cases in which a legal norm establishes it.

You have the right to obtain confirmation as to whether at BARBELL STUDIO, SL we are processing personal data that concerns you, or not. Likewise, you have the right to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected.

In certain circumstances, you can request the limitation of the processing of your data, in which case we will only keep it for the exercise or defense of claims.

In certain circumstances and for reasons related to your particular situation, you may object to the processing of your data. BARBELL STUDIO, SL will stop processing the data, except for compelling legitimate reasons, or the exercise or defense of possible claims.

Likewise, you can exercise the right to data portability, as well as withdraw the consents provided at any time, without affecting the legality of the treatment based on the consent prior to its withdrawal.

ELEVENTH.- FRAUDULENT PARTICIPATIONS

Participation in the contest fraudulently (use of robots, non-manual systems, hacking, etc.) will result in automatic elimination of participation in the contest, without the right to any prize that has been assigned in commission of fraud or deception. Without prejudice to the aforementioned, POWERBARBELL's will is to provide a space suitable for the purpose of this Promotion, which is why a filter will be carried out in relation to the content of the participating comments, being entitled not to publish said comment on depending on its content, or the following attitudes are observed:

• Defame, abuse or violate the legal rights of other users in relation to their publicity and privacy.
• Discriminate, based on race, sex or religion, opinions or comments made by other users.
• Publish directly or through links defamatory, obscene, violent or offensive content for third parties.
• Violate Industrial or Intellectual Property rights.
• Incorporate viruses or other physical or electronic elements that may damage or prevent the normal functioning of the POWERBARBELL page. The verification of any of the circumstances mentioned during the promotion will result in automatic disqualification and prohibition from participating in the promotion.

TWELFTH.- TAXATION

Law 35/2006 of November 28, which approves the Personal Income Tax, will apply to the prizes of this promotion; Royal Decree 439/2007, of March 30, which establishes its Regulations as well as its subsequent modifications and development rules. Law 25/2009, of December 22, Modification of various laws for their adaptation to the Law on free access to service activities and their exercise and Law 13/2011, of May 27, will also apply to them. Regulation of Gaming, as well as the other concordant provisions issued in its development, so, where appropriate, it will be up to the commercial entity POWERBARBELL to make the payment on account or practice the appropriate withholding of the Income Tax of the Individuals (hereinafter IRPF). For the purposes of the aforementioned regulations, it is stated that the prize does not exceed 300 euros.

THIRTEENTH.- MODIFICATION AND/OR CANCELLATION

In any case, the Organizer reserves the right to modify these Rules at any time, without prejudice to the fact that it will make the corresponding announcement through the means used to disseminate the Promotion, without assuming any responsibility, as well as due to a cause of force majeure or circumstances beyond the control of the organizing entity, committing to communicate the new Bases and conditions of participation with sufficient advance notice.

Likewise, and whenever there is a justified and duly motivated cause, the Organizer reserves the right to cancel the Promotion. In such case, and provided that the period expressly established in these Rules has not expired, the Organizer does not commit to assigning the Prize.

In the event that the Promotion period has ended, with cancellation occurring after this, the Organizer undertakes to deliver the Prize in accordance with the conditions established in these Rules. However, the above will not apply when the cancellation of the Promotion is due to force majeure or circumstances that are beyond the control of the Organizer, and the Organizer will not be obliged, in such case, to award the Prize to any Participant.

In particular, the Organizer will not be obliged to deliver the Prize in the event of total or partial cancellation of the Promotion.

The Organizer reserves the right to make changes that result in the successful completion of the Promotion when there is a just cause or reasons of force majeure that prevent it from being completed in the manner set forth in these Rules. The Organizer reserves the right to postpone or extend the period of participation in the Promotion.

The Organizer reserves the right to cancel, suspend and/or modify this Promotion, to change or vary any condition or requirement thereof and/or these Rules. In all the cases mentioned, users would be informed in advance through the means used to hold the Promotion.

FOURTEENTH.- SAFEGUARD CLAUSE

All clauses or extremes of these Bases must be interpreted independently and autonomously, and the rest of the stipulations will not be affected in the event that one of them is declared null and void by a final court ruling.

In such case, the Organizer will replace the affected clause or clauses with another or others that have the effects corresponding to the purposes pursued by the parties in these Rules.

FIFTEENTH.- APPLICABLE LAW AND DISPUTE RESOLUTION.

The current regulations will determine the laws that must govern and the jurisdiction that must know the relations between the Organizer and the Promotion Participants. However, in those cases in which said current regulations provide for the possibility for the parties to submit to a specific jurisdiction, the Organizer and the Participating users, expressly waiving any other jurisdiction that may apply to them, are subject to the legislation. Spanish and to the Courts and Tribunals of Valencia Capital.
